1. Acceptance of Terms
By accessing or using the NCLEX Adaptive Prep platform (“Service”), operated by NCLEX Adaptive Prep (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
2. Description of Service
NCLEX Adaptive Prep is a web-based educational platform that provides adaptive NCLEX-RN exam preparation tools, including practice questions, computerized adaptive testing (CAT) simulations, analytics dashboards, study materials, and related features. The Service is designed solely for educational and test-preparation purposes.
The Service is notaffiliated with, endorsed by, or connected to the National Council of State Boards of Nursing (NCSBN), Pearson VUE, or any state board of nursing. NCLEX® is a registered trademark of NCSBN.
3. Account Registration
To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Subscription Plans & Payments
The Service offers free and paid subscription plans. Paid plans are billed on either a monthly or 6-month basis as selected at the time of purchase. All prices are listed in U.S. dollars. Payment is processed securely through our third-party payment provider (Stripe). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
We reserve the right to change pricing at any time. Price changes will not affect active subscriptions until the next renewal period. You will be notified of any price changes before they take effect.
5. Refund Policy
If you are not satisfied with the Service, you may cancel at any time. Upon cancellation, you will retain access to paid features until the end of your current billing period. For billing inquiries, contact us at support@nclexadaptiveprep.com.
6. Cancellation
You may cancel your subscription at any time through your account settings or by contacting us. Upon cancellation, you will retain access to paid features until the end of your current billing period. No partial refunds are issued for unused portions of a billing period.
7. Acceptable Use
You agree not to:
- Share, redistribute, or resell your account access or any content from the Service.
- Use automated tools, bots, scrapers, or scripts to access or extract content from the Service.
- Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
- Copy, reproduce, or distribute questions, rationales, or any proprietary content.
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Interfere with or disrupt the Service or its infrastructure.
- Misrepresent your identity or impersonate another person.
Violation of these terms may result in immediate suspension or termination of your account without refund.
8. Intellectual Property
All content on the Service — including but not limited to questions, rationales, study materials, graphics, software, algorithms, trade names, and trademarks — is the proprietary property of NCLEX Adaptive Prep or its licensors and is protected by U.S. and international copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access and use the content solely for your personal, non-commercial educational purposes.
9. No Guarantee of Exam Results
The Service is a study tool and does not guarantee that you will pass the NCLEX-RN or any other examination. Pass rates and readiness scores displayed within the platform are statistical estimates based on your practice performance and should not be interpreted as a guarantee of exam outcomes. Your exam results depend on many factors beyond the scope of this Service.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NCLEX ADAPTIVE PREP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
12. Indemnification
You agree to indemnify, defend, and hold harmless NCLEX Adaptive Prep and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Third-Party Services
The Service may integrate with or contain links to third-party services (e.g., Stripe for payments, Supabase for authentication, Google for OAuth). Your use of such services is governed by their respective terms and privacy policies. We are not responsible for the practices of any third-party services.
14. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive.
15. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the United States and the State in which NCLEX Adaptive Prep operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
